PRIVACY POLICY

SECTION 1 – POLICY COVERAGE

Consistent with the provisions of the USA Internet Security and Privacy Act, the Freedom of Information Law and the Personal Privacy Protection Law, and the EU General Data Protection Regulation (“GDPR”), this Privacy Policy (“this policy”) discloses the privacy practices of Applied Archetype Solutions LLC (“Archesol” “we” “us” or “our”) and outlines how personal identifiable information and other personal data (“user information” “customer information”) will be collected, used, and shared from users of this website (“Customers” “users” “you” “your”), in connection with your access to and/or use of the Archesol website and any content, features, services or other offerings that Archesol may provide in connection therewith (collectively, the “Site”).

The Site is owned and operated by Archesol. This policy does not apply to any person or company that is not owned, operated or managed by Archesol, and does not apply to any other companies’ or organizations’ websites which are linked within Archesol’s website. Archesol recommends that you review the privacy policy at each such website to determine how that website protects your privacy. This policy applies only to customer information collected by us.

For purposes of this policy, “personal information” means any information concerning a natural person or company, which, by virtue of its name, number, symbol, mark, or other identifier, can be used to identify that person or company. Archesol does not collect any personal identifiable information and personal data about Customers unless such information are provided voluntarily, whether solicited or unsolicited, by sending us an e-mail or by initiating an online transaction with Archesol, such as completing a Customer registration and submitting an online purchase order form through Archesol’s website.

This policy also describes your choices and rights regarding the use, access and correction or deletion of your user information. By using the Site, you consent to the use of your user information in accordance with this Privacy Policy. If you are an EU resident or individual, you will also be asked to provide clear and unequivocal affirmative consent to the collection, processing, and sharing of your user information via cookies and similar technologies.

Notice to EU Resident/Individuals: this Privacy Policy and its enumerated policies are intended to comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the “General Data Protection Regulation” or “GDPR”) and provide appropriate protection and care with respect to the treatment of your user information in accordance with the GDPR.

SECTION 2 – PRIVACY STATEMENT

Customer privacy is very important to Archesol. Any user information provided to Archesol, whether solicited or unsolicited, which may be used to identify a person or entity, including name, address, phone number, etc., is used only for the purpose of completing a purchase transaction made through the Site and communicating with relevant parties regarding products catalogued in Archesol’s website. These communications may be with certain business partnerships or affiliated companies or the Original Equipment Manufacturers (collectively, the “Associates”).

Archesol will not give, sell, transfer or make available to any company outside the Associates any information that may be used to identify a company or person except when required by local, state or federal law. Any inspection of electronic data and/or files, and any action based upon such inspection, will be governed by all applicable laws and law enforcement agencies.

If you have any requests, comments, or questions about this Privacy Policy or your user information, or to request removal of your personal information from our registry, please contact us in the manner provided in Section 10 below. In some cases, we may not be able to remove personal information voluntarily disclosed by you for legal retention purposes (e.g., the data may not be necessary to complete a purchase transaction), in which case, we will notify you if we are unable to do so.

SECTION 3 – INFORMATION COLLECTION AND USE

Archesol will only collect personal information through this website, or disclose such personal information, subject to Customer’s acceptance of Archesol’s Terms and Conditions of Purchase. The voluntary disclosure of personal information to Archesol by the Customer, whether solicited or unsolicited, constitutes consent to the collection and disclosure of the information by Archesol for the purposes for which the Customer disclosed the information to Archesol (e.g., when setting up an account or submitting a registration or purchase order on the Site), and as was reasonably ascertainable from the nature and terms of the disclosure.

Customer Registration

Archesol may collect user information that is voluntarily provided by you or with your permission. For example, we may ask you for information, such as your e-mail address, when you register to become a registered customer of the Site or register for any special promotion. In the event you order something from the Site or one of our co-branded websites, we may request additional personal information, such as your address, telephone number and credit card information, in order to complete the purchase. You always have the option not to provide the information we request. If you choose not to provide the information we request, you can still visit most of the Site, but you may be unable to access certain options and services. When you register or become a member of the Site or provide information to Archesol in any other manner, you agree to provide only true, accurate, current and complete information.

Further, the disclosure of information, including personal information, collected through this website is subject to the provisions of the Freedom of Information Law and the Personal Privacy Protection Law. Additionally, Archesol may disclose personal information to federal or State law enforcement authorities to enforce its rights against unauthorized access or attempted unauthorized access to Archesol’s information technology assets and any other inappropriate use of its website.

Notice to EU Resident/Individuals: As outlined in this policy, Archesol will not process your personal information without a lawful basis to do so, as such bases are defined in Article 6 of the GDPR. In general, Archesol will process your personal information on the legal bases of consent, contract (if you have entered into an agreement with us and such processing is a necessary part thereof), or legal obligation (as noted above). Archesol may also process certain personal information on the basis of the following legitimate interests, provided that such interests are not overridden by your privacy rights and interests: delivering and continuing to develop and improve the Site, learning from your behavior on the Site (e.g., analyzing traffic) to better serve you and other Site users, helping us modify or enhance the Site and its content, receiving insight as to what users do (and don’t) like about our Site or aspects thereof, and providing a stable, consistent, and secure user experience in connection with the Site.

Email marketing (if applicable): With your permission, we may send you emails about our website, new products, services, and other updates. If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, at any time, by informing us in the manner specified in Section 10 below.

SECTION 4 – PAYMENT CARD INFORMATION

If you initiate a payment card transaction through an online application on this website, Archesol provides a data entry screen that securely transmits your data directly to a third-party Payment Card Industry (PCI) compliant payment card service provider. Archesol does not receive or retain any of your payment card or account information. The payment card service provider transmits only a successful or unsuccessful confirmation message back to Archesol so that Archesol can properly complete the transaction. For more information about PCI compliance, visit the PCI Security Standards Council website.

PCI requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 5 – THIRD-PARTY SERVICES

In general, the third-party service providers used by Archesol will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these service providers.

In particular, remember that certain providers may be located in or have facilities that are located at different jurisdiction than either the Customer or Archesol. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

As an example, if you are located in the Middle East and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act.

Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy.

When you click on links on our store, they may direct you away from our website. Archesol shall not be responsible for the privacy practices of other sites and encourage you to read their privacy statements.

SECTION 6 – COOKIES

Like most, if not all, e-commerce merchants, Archesol uses cookies, small pieces of data stored on your computer and delivered through your web browser, to store non-personal information about you. By using this technology, Archesol can provide you with an enhanced user experience and save you time while using its website. It is possible for you to turn off cookies in your web browser; however, if you decline or delete these cookies, some parts of our website may not work properly.

Cookies fall into the subcategories below.

Essential Cookies. Certain cookies are used for specific purposes that are essential to your secure use and navigation of the Site. Without them, Archesol may not be able to provide core Site functions and features to you, and the Site would not operate as well as you or Archesol would like. These cookies collect and use information such as your server preferences, single-session data and corresponding identifier, and other credential-related information. For EU Resident/Individuals, essential cookies also help inform Archesol whether you require, or have already been served, an affirmative consent request in connection with the GDPR. Essential cookies include analytics cookies, which provide us data that allows Archesol to better understand its users and improve the Site based on what we have learned from that data.

Advertising Cookies. To help support the Site and further tailor your experience, Archesol and its advertising partners (and/or their third party analytics providers) also use cookies on the Site to personalize the content and advertisements you may be shown. Such advertisements use cookies to provide you targeted advertisements that may be more consistent with your interests than non-targeted advertisements. Certain Archesol advertising partners may also use cookies to monitor or track the performance of their advertising content. Archesol does not provide user information to advertising partners except in connection with the Site or as required by law.

We encourage you to consider keeping your cookies enabled, as if you choose to disable the receipt of cookies from our Site, you may not be able to use or benefit from certain features of the Site, particularly the features that are designed to personalize your experience.

Most web browsers automatically accept cookies, but generally allow users to modify their browser settings to display a warning before accepting a cookie, to accept cookies only from certain websites, and/or to refuse all cookies.

SECTION 7 – SECURITY

We care about the protection of your user information and use industry standard safeguards to do so. Of course, it’s important to keep in mind that no data transmission on the Internet is guaranteed to be 100% secure.

Your information is stored on Archesol servers located in the United States. We use industry standard physical, electronic, and organizational safeguards to protect your user information against loss or theft as well as unauthorized access and disclosure to protect your privacy. Archesol limits employee access to personal information collected through this website to only those employees who need access to the information in the performance of their official duties. Employees who have access to this information are required to follow appropriate procedures in connection with any disclosures of personal information.

These Security measures have been integrated into the design, implementation, and day-to-day operations of this website as part of our continuing commitment to the security of electronic content as well as the electronic transmission of information. Whilst we employ many different security techniques to protect such data from unauthorized access by users inside and outside the Site, “perfect security” does not exist on the Internet. If you are concerned that your privacy may have been breached, please contact us as provided in Section 10 below.

SECTION 8 – CROSS-BORDER TRANSFER OF INFORMATION

Your user information may be transferred to other countries in connection with your use of the Site. If you access or use the Site outside of the United States, your user information will be transferred to our servers in the United States.

You have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. If you would like to exercise this right, please contact us through the contact information in Section 10 below.

Additionally, if you are a EU Resident/Individual, we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests as reasonably ascertainable when using the Site. Additionally, please note that your information will be transferred outside of Europe to the United States. When you place an order through the Site, we will maintain your Purchase Order Information for our records unless and until you ask us to delete this information.

SECTION 9 – CHANGES TO THIS PRIVACY POLICY

We reserve the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you by means of a notice on this website prior to the change becoming effective, or by email (sent to the e-mail address specified in your registered account). We also encourage you to periodically review this page for the latest information on our privacy practices.

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you. You will be notified via your registered email prior to the transfer becoming effective.
